Delta 8! Everyone has been raving about it, but the darling of the cannabinoid market hasn’t been received everywhere with the open arms we feel it deserves. Everything’s bigger in Texas, which applies to the states gripe with Delta 8.
Delta 8 THC is legal in Texas because it falls under the protections of the Farm Bill. The Farm Bill includes a section on industrial hemp that defines hemp as cannabis Sativa L. with less than 0.3% THC on a dry weight basis.
Since the ruling, the Texas Department of State Health Services (DSHS) has been working to get Delta 8 placed back on the Schedule I Controlled Substance, and in October 2021, they won. Retailers, as well as customers, were left confused and waiting for clarification, with some retailers stating they were never even informed of the change, leaving them open to getting themselves in trouble. Most of them, however, refused to stop selling until directed otherwise.
The good news is, a short time after, the ruling was successfully appealed! As of right now, it is perfectly legal to purchase Delta 8 products in Texas. Since the appeal, the state has made multiple efforts to overturn the appeal, so we suggest a checking here for updates, just to be safe.
That being said, Texans (of age) are more than welcome to pop a gummy (or 2 or 3 or 4) before they get their dinner cooking, a movie started, or before watch a game of football. Happy consumption!
